The arresting officer’s statements may be discredited due to inconsistency. He must follow these guidelines in order for the roadside tests to be valid:

  • Reasonable suspicion that you violated a motor vehicle violation
  • Probable cause to arrest you and
  • Consent before he administers the roadside tests
  • Reads you your Miranda Rights

You don’t have to lose your license for a year. If you are a first time offender you are eligible for a limited privilege after 10 days, pretrial and are eligible for a limited driving privilege on the date of conviction.
