The District Attorney may be lacking evidence or witnesses to prove your case and may have evidence to prove your innocence.

The arresting officer's statements may be discredited due to inconsistency. He must follow these guidelines in order for the roadside tests to be valid:

- Reasonable suspicion that you violated a motor vehicle violation
- Probable cause to arrest you and
- Consent before he administers the roadside tests
- Reads you your Miranda Rights


You don't have to lose your license for a year. If you are a first time offender you are eligible for a limited privilege after 10 days, pretrial and are eligible for a limited driving privilege on the date of conviction.
